My opinion will not be popular, and I don't have that many posts left...so I will cram everything into this post.

I am not worried about protection at this point and I do not think it is holding up news or trials directly...I think it is holding up possible partnership paths, because the plus path equals the longest protection for the least amount of future future work. We are actually still protected (but time is running out) under the original Greek patent.

The timing of the last Anavex issued patent was about 3 to 4 months from Allowance to Issuance. Unfortunately I am confused at the time of Allowance because the USPTO documents say that Reasons for Allowance is filed once the claims have received allowance. The transaction history shows a Reasons for Allowance but not a notice, so I am not sure I would start the 3 to 4 month countdown yet. Another source that looked at allowance to issuance times of hundres of patents showed the average being 3 to 4 months as well (cannot locate link at the moment)

This will be my unpopular thought...but is my opinion...I believe as Dr. Missling stated, we are waiting for PK/PD data, but I think he really means we are waiting for the best patient profiles derived from that data. I think that is only one missing piece. I think funding is the biggest issue at the moment, not obtaining it, but finding the best path. I think there is a priority list of funding paths. I may not have the order correct, but we have mentioned all of them in our conversations. I think each possible path is prioritized with a complimentary need:

1. Full Funding from governments, grants, foundations, etc. to retain full control of decision making ability, profits, etc.

2. Majority funding from above with a small remainder from preferred shares...oops LPC now.

3. Partnership with BP (held up by patent IMO see reason above) Possibly requiring preferred shares (oops not anymore).

4. Controlled LPC funding

5. Issue new shares


I think all of those in whole or part are viable.
