When it is patented it is protected, regardless of how narrowly. If a business steals it as a business strategy they do what is coined as "efficient infringement". If the benefits out way the costs, they do it. It is not a criminal act, so there is no jail time. They pay an amount that is less than the amount they profited and everybody is happy...although the plaintiff is probably still pissed.
