I think he had an excellent chance of winning. Did you read the pleadings?

But all he'd have "won" would have been the shell, and shells are a dime a dozen. Civil actions nearly always settle, and they're nearly always about money. If you want the other side to go away, you offer cash.

Bosticco's gripe was that Tracy hadn't fulfilled his duties as custodian, and was not proceeding to do so in a timely manner. When he objected, Tracy removed him as an officer/director. That was what persuaded Bosticco to hire his own attorney.

We'll probably never know how the matter was resolved, but my guess would be that Tracy returned, or has promised to return, whatever money Bosticco paid him.

devil dog- <<Maybe Bosticco got tired of paying his lawyer for something he knew he was not going to win.>>

Perhaps... Also possible that the lawyer became overtly aware of the 'facts & law' as he was preparing his 'last' papers and convinced he was championing a 'frivolous' case vulnerable to punitive sanctions and all the legal costs of the other party that both he & client would be exposed to. (when that happens it takes both party's to agree to a dismissal; a very weak & hazardous position to find yourself in).

I see it as a good sign that TRON is anxious to move ahead ASAP, and that Rene cares enough about shareholders to give such news promptly.

GO TRON!
