I didn't miss the point - I believe that my point was mistaken.

If there was substantial evidence of Otiko breaking federal law as implied by the lawsuit, Otiko would be finding himself charged in Criminal Court.

Since there isn't evidence of this, it is currently in Civil.

Now - if I had evidence to prove my case, I would submit this work to the Feds, and have him charged, and then my chances of winning would be significant because of course he was guilty.

If he had a leg to stand. You sick the feds on him then file a civil suit against him to gain assets from him after. If this was true he would be dumb not to involve them first. Being a lawyer and the fact he didn't tells me it holds no water. IMO
