Their lawsuit dragged on 5 years and not getting anywhere. I doubt it get settled this year too. Judge thought it was a weak case but doesn't stop the law firms from continuing the case if they think they can get something out of it. If it was bad enough don't you think the lawsuit would have settled long ago.
RS voting coming May but we don't know if price will stay this low by then. The recent guidance is a positive one obviously trying to keep the stock from going under 1$. It doesn't take much to push this above 1$ again. So it's definitely risky play at this time, but long term, it looks promising.
Could choose to wait and see if RS will happen, but waiting could also means missing out on current low price if this keeps trending up.
