Actually that is not why Martha Stewart was convicted.

The problem was that her advisor also said that was because so-and-so was going to sell

By the way, the "so-and-so" was the company CEO. He got 7 years for insider trading.

She was convicted for lying to the FBI about the reasons behind the trade and trying to cover up the call from her broker's assistant by manipulating records.

She was not charged for the trade itself.
