Nok is saying to the arbitration panel that Ericy/Sony does not reach under option 3, but if you believe it does, then we challenge the surrounding circumstances under which the rate was set by Ericy/Sony and IDCC. I did not say Nok was correct. All I am reporting is my opinion of the arbitration issues. My concern is the confusion created by the panel should they agree with Nok concerning Ericy/Sony. It could put the parties back at square one waiting on other Named OEM's to license. This would not be good for IDCC with regard to timing and cash flow while waiting on 3g and its licensing obstacles.
