Watch how wrong you turn out to be. If what you say is true there would have been a motion to dismiss based on no damages. If what you say is true then there would have been a summary judgment motion filed.

There are damages and making a simple observation no business no damages is absurd.
HAVING NO BUSINESS IS NOT ABSURD! IT IS A FACT!

To support this thinking, were I the opposition's attorney, it would be most "damning" to cite Seth Shaw's litany of failed initiatives, assuming CEO Shaw is posturing to claim..."but we coulda been a real business"!
