Hey Ziploc -- Doesn't your post sound very similar to the situation with Ericson in '93 when apparently they were at the final draft of an agreement between IDCC and ERICY. All of a sudden--BOOM--Ericson supposedly did an about face and filed suit! As Hyman Roth said- "This is the business we've chosen"!
have heard that Nokia had essentially agreed to the rate settlement and had sent IDCC draft papers to that affect. Allegedly, there was a problem with one aspect of the draft that IDCC did not agree with and sent it back to Nokia for revision. ]
If this is an accurate portrayal of the negotiations and if this draft could be submitted as evidence in federal court and arbitration, then it would simplify matters. Judge Lynn could see if the documents requested was germaine to the " problem with one aspect of the draft" and this would be the only thing that the arbitration panel would need to decide.
