Like I said, Supreme Court to decide

My post clearly stated that the DC Court of Appeals said that Judge Elliot's wasn't an appointment, because his rulings weren't final, and so he's just an employee.

OTOH, the 10th District Court of Appeals in CO says that he is an appointment, and so violates the Appointments Clause.

The Supreme Court will have to decide which court is correct.
