It is just a proposed order, submitted with a declaration from Seth Lapidow at Blank Rome, so it's still up to the judge/magistrate to approve and issue the order. He can apply the proposed order to all the parties, if he chooses. I'm not reading too much into this, at this moment. I'm just going to sit back and let this play out in favor of us longs.
Isn't that curious! Ya got to wonder if the power behind the throne (Singapore Telecom which owns 97% of Trustwave) had anything to do with this. Since they are on the hook for any potential settlement fees or treble damages I imagine they are quite concerned about the court's proceedings IMHO.
