Why would you characterize a motion for summary judgment as probable? Wouldn't the four brokerage defendants fight any such motion proposed by COR? The current summary judgment exists only against the defendant Adam Carter of CRGP and is uncollectable. The brokers won't roll over and allow a (collectable) summary judgment to be placed against them. Their top lawyers are already on board to fight this case to settlement or trial. I would add that the highly confidential data submitted to the court by DTCC via the plaintiff COR is the wildcard in the mix that will likely determine the direction and depth of the final ruling. Again, my guess is that this goes to trial, or at the very least has a very late day settlement arrangement.
