Not a legal use of Section 3(a)(10)? It was both a specifically approved condition of the debt settlement and was ordered by a Judge:

As condition to the RCP Settlement, RCP and the Company filed a civil action under Section 3(a)(10) (the “3(a)(10) Transaction”) of the Act. On November 30, 2016, the Circuit Court of the Twelfth Judicial Circuit in and for Manatee County, Florida, entered an order approving, among other things, the fairness of the terms and conditions of the 3(a)(10) Transaction.

Anyone concerned about rule 144 or Section 3(a)(10) not being properly addressed in the debt settlement should probably just take it up with the Judge who decided and ordered the actions.

With all the new convertible debt dumpage coming, what else can it do?
