I'm guessing that your favorite CEO is the source of that misunderstanding given that one of the company's directors was under the same false impression.
A company can't "raise money relying on rule 144" whether it is current in its reporting or not.

Rule 144 impacts the ability of holders of restricted shares to sell them.
