I have spoken with some pretty knowledgeable lawyers, and none see that scenario...

But again, I prefer a settlement here.

You are going back to square one and that is not going to happen. The battle CCGI motion which claims it was all 350 green case was already tried and JNSH WON THE CASE. That was dragging on for over two years. MAKE NO MISTAKE: NOW IS THE SETTLEMENT DAMAGES PHASE.

The reason Elaine E. Bucklo pushing back the the hearing is because that make more sense. She is tired of CCGI B/S and wan't to make sure both party are come with the solutions for settlement by Oct 21, 2016.

CCGI will have no other choice if they are not settle, then the hearing is kick in and bucklo will dismiss the case with the awards a judgement for JNSH.

ABSOLUTELY NO NEED TO TAKE ANOTHER 18-24 MONTH. This is the end of the battles and the end of the lawsuit.
