#164438 RE: j70k #164431

If the original Nok license were to run its course to normal expiration with no 3G trigger occurring, is that tantamount to a $0 royalty rate, such that IDCC loses the right thereafter to claim infringement and future royalties?

In other words, is the Nok 3G license in effect paid up? Or, does it simply expire and a new replacement of some sort is needed?

In the case of Nok, it seems the 3G portion of their license was terminated, per the recent 2G/3G settlement, with 3G infringement and possible legal action as the future course, after some mutually agreed, but not disclosed, time delay.

But, if Sam gets the original Nok 3G license and does not follow Nok into the recent settlement, so the original Nok 3G terms apply to Sam, then what does that mean to Sam if there is no trigger event and their 3G license expires with no royalty obligation?

TIA,
