Anyone who wishes to. It doesn't matter what the lawyers name is. Whoever it is (if anyone) they wont be doing it before the litigations naming WAMU are ALL completely concluded and escrows are removed without any payment (or what some consider not to be F&R).
That is the whole point of my statement. Lots of people want to say the fact that there are no law suits is proof that there is nothing. That is just plain wrong. NOBODY can sue till the case is over.
