That was certainly the case for 2g, but CDMA only had 20% of the market. W-CDMA and the chips help, but I maintain that licensing for the same rate structure to all is the key. Nobody likes paying royalties, but the assurance that everyone is also paying the same rate places them on a level playing field without some having a margin advantage. This certainly helps with customer relations because nobody will discover that a competitor is getting a better deal from Qcom. It only makes sense that if all products are made to standards, all rates for SEP's should be standard initially. Naturally, a willful infringer should have to pay more or a big manufacturer should get a lower rate after attaining certain levels, but everyone should start on the same page. The biggest reason IDCC has trouble with renewals is the licensee has discovered that other manufacturers have received a better deal or no deal at all. The second biggest reason is that IDCC has yet to attain a final judgment of infringement of a valid patent. The two patents in the Zte case found valid and infringed by the jury did not get the same finding in the ITC case. The jury finding is now being appealed and hopefully it will be upheld. We simply must win or we have no clout at renewal time of our existing licensees. If we lose, we must consider a merger/acquistion with or by a manufacturer and engage in cross-licensing with the large manufacturer/R&D shops dominating the wireless market. In the alternative come up with niche, non-standard, add on that goes viral with the consumers.
