#31897 RE: DrZem #31895

"My attempted point was that Sherman Act violations had nothing to do with the rulings. "

Of course they did....the Sherman Act violations were counter-claims dismissed in the Consent Judgment:
"all of PharmaTech’s counterclaims in this action against LifeScan, are hereby DISMISSED WITH PREJUDICE".

"Dumping Pacer text, that had already been posted on the forum was not useful to me."
It should have been useful..you were clearly unaware of it. I searched for the following and it appears not to have been posted previously:
Document #258 in the case, entitled
"ANSWER TO THE FIRST AMENDED COMPLAINT AND COUNTERCLAIMSOF DECISION DIAGNOSTICS CORP., fka
INSTACARE CORP., AND PHARMATECH SOLUTIONS, INC.
1. VIOLATIONS OF THE SHERMAN
ACT, 15 U.S.C. § 1 (CONTRACTS IN
RESTRAINT OF TRADE)
2. VIOLATIONS OF THE SHERMAN
ACT, 15 U.S.C. § 2 (ATTEMPTED
MONOPOLIZATION)"
