Walrath never allowed equity to renegotiate the global settlement agreement. The GSA was entered into at a time when senior note holders had the say and control over the Debtors and in order to get the 4 billion deposit free and clear for the payment of their claim it was quite easy for them to give up the fight for equity assets.
