Wow, that is very interesting and significant. Why and How would Kent have this updated back if he was PERMANENTLY gone or his goal was that? This wasn't the "way" I saw this story continuing, step-wise, but certainly supports what I still believe might occur.

Rescission of not, and it seems like it was "completed", his appointment to the board and EVs removal was a completely separate action and wasn't a condition or "deliverable" of the settlement agreement. If one reads the recitals, EV and crew had already agreed to "leave" on 9/3/15 and the The settlement agreement was on 9/30/2015.

"WHEREAS, on or about September 3, 2015, Vakser agreed to resign his position as a Director of the Company, to effect the resignations of the other then-serving officers and directors of the Company"

On 9/11/2015 - The resignation of EV's crew and also the appointment of Kent to the board and also CEO was confirmed as completed and disclosed, read below.

Kent could have just easily surrendered his position after a likely rescission but choose not to, that's significant.

Sometimes a piece of a puzzle thought to be the most important piece turns out to be just a piece after all.
