The lawsuit was between Cognate (a vendor for NWBO) and their ex president, Alex Smith. Smith sued Cognate for back pay. In defence of that case, LP raised the IP theft issue. Smith won his case with the jury finding he did not misappropriate any data.

While that was going on, LP initiates a counter suit against Smith on the same issue.

LP did add the Macrocure as a defendant to the counter suit. But in the recent dismissal, the court ruled that this was just the same case, and therefore already decided.

In short, what was going on was a suit between a vendor of NWBO and there former employee who subsequently when to work for the company Wolf was a director at.

I fail to see why this would raise to the level of an issue the BOD would be involved in. It looks like a routine matter, and therefore not under the BOD's scope. It does touch on the character issue for Smith (former head of US ops for Macorcure), so perhaps she should have been aware for that reason. But I do not even know if he was still at the company when Wolf arrived.

On a related issue, I find the idea that taking notes and asking questions shows guilt to be hilarious. Are the current "investigators" going to take notes and ask questions?
