Normally a SPA can only be given for Phase III trials, but there are exceptions. The one I am familiar with is rare diseases, and in that case a SPA can be issued for a phase II trial. I'm guessing here, but if the Direct phase II trial is again for inoperable cancers, and due to the fact the phase I was large, I wonder if an exception can be made for their phase II trial?
