That is one of the most illogical statements I've ever read. ALL the claims in the counter action were throw out and DISMISSED.Not just the one against Mr. Scivoletto.
In the vast majority of cases, even though some of the counterclaims are thrown out, the court will let stand one or two claims that may have some merit (or are at least arguable) in an effort to be absolutely fair. Rarely is an entire counter action and all the claims in it swept aside and summarily DISMISSED. Even more rarely, does one see the words sua sponte; and almost never does a Federal Judge accuse a party of "Smuggling."
Yet, rare as it is, MW has managed to lose 100% of his counterclaims ... on top of getting caught red-handed trying to smuggle in a claim. he must have thought the Judge was as dumb as his bagholders. Obviously, Judge Unora has a few more brain cells than MW thought.
