Yes, it is an asset. The asset is footnoted in the S1. Since the transaction occurred in Q4 of 2015, it will be shown on the balance sheet of the EOY 2015 financials and the Q1 2016 financials.

IMO this sounds like the same type of silly excuses Gary F Kimmons was using while selling billions of discounted shares....Huh?

How can this true? Where is there any public information where this can be verified?
