Thanks for the response, you seem very knowledgeable in regards to patent litigation, so for clarity (as I am not as strong in the details as you appear to be)...

1. What is the interplay between the MSJ and IPR? My understanding is Activision was unable to request an IPR due to delay issues and thus had Bungie effectively do it for them, and the issue at hand is that Bungie is effectively a proxy for Activision.

2. The MSJ is Activision hoping they can get off scott free on an Alice/101 defence. So a two pronged approach at preventing a trial

3. If you concur with the above (if not, please feel free to correct me), in regards to your response to the article - you say "until they (ptab) decide if they are going to undertake a full inquiry" - do we know when they will decide this and if so is such discovery typical?

I got into VRNG after much of this occured with Google so this is a part of the process I do not understand well.

Looks like Bungie just got themselves added to the infringers list (ahead of schedule).

Now WDDDs has little choice except to sue them to get the PTAB discovery it wants approved. This is good for shareholders. Susman has the Legal bill covered and to protect their investment, will be adding Bungie to their list. Overall, good news.

If I'm reading this correctly, since the Bungie set-back, it looks like the WDDD's next action is to seek documents to prove the relationship between Activision and Bungie. Bungie won in the preliminary phase, now WDDD is going to seek discovery documents to prove the relationship between Activision and Bungie. This Bungie set-back can be thwarted during the formal stages of the review by proving collusion.

Remember, the best thing we have going for us is S & G, one of the country's best law firms. They know what they are doing.

Data, why would the Board deny discovery in the preliminary phase, but allow it during the full inquiry?
