very interesting...can you provide an example of when this has happened to an actual major exchange listed emerging biotech in the last 3 years?

Im not saying it hasnt but I am saying that it is a shareholder class action waiting to happen...its fraud under some circumstances and there is likely a paper trail for such a scheme...taking your company private is perfectly legitimate...holding yourself out as a publicly traded company as a subterfuge to obtain retail investor funds to support your plan to go private is different....no need to uplist if you intend on going private...

I thought they already have a poison pill - preapproval from the BOD to sell xx million of shares if/when they see fit.
