This is the part of the FDIC memo mordicai focused on to base his theory. He is saying that those assets in "legal isolation" are non bankruptcy assets. Hence ownership would revert to WMIH.

Nope, az is wrong. WMIH in not the successor to WMI. The WMILT is the successor to WMI, WMIH is a totally NEW company, free and clear of anything from the past of WMI.
