I think the patent issue is simple. The company is waiting until it has a large amount of cash on hand (maybe soon now that the warrents are starting to be exercised, or maybe later after partnership or some such). At that time it will allocate some of the money toward either giving Vamvakides the extra dough he wants to stop holding things up, or taking him to court and forcing him to honor the contract that obligates him to assign the patent to Anavex. Presumably the company will pursue whichever option appears cheaper and then the patent will be secured. I believe it already is secured -- just a matter of when the company feels it has the cash needed to act and complete the formality (followed by however much time is built into the uspto procedure).

Sounds like the SA article, or at least an interview relating to $AVXL by Kanak, will be published tomorrow and should shed some more light on the patent debate. He did note in comments today over at SA that in his opinion it appears to be 'mostly a non-issue.' Looking forward to $AVXL ending the week on a high note! GLTA!!
