Thanks for the info. So it seems that a particular brokerage should not be able to continuously create "failure to deliver" shorting transactions. Are there really no penalties for rampant abuse of this?

But I still don't understand why NSS is necessary, why legal shorting wouldn't suffice. There should be plenty of shares available to initiate a short. It's just the covering that is difficult at these prices.

Right if they cant find a seller they are screwed, that's why it's important for longs to hold till they can sell for a profit in this situation.
