So...I guess you missed the part where the US Attorneys Office stated that the promoter, BIG Investment in this case, got paid $50,000 but BIG Investment only disclosed a payment of $25,000.

Butt BIG Bennie did NOT report his compensation for pumping NTEK until many months later when the OTCMarkets.com "financials" came out and showed that he was awarded millions of NTEK shares in April, 2014 "pursuant to a pre-existing contract" for promotion - which BIG had engaged in spades since summer 2013 - without any disclaimer or disclosure of his compensation for pumping NTEK.
Of THAT, there is no doubt. It's very well documented.
And that's where his real liability lies - HUGE dollar amount liability (under joint and several liability for a criminal conspiracy).
Which is why, if he was smart, he'd be in the FBI offices tomorrow with a proffer on FNRG and his other scam promos - especially NTEK - working out a deal NOW. His information asset is rapidly depreciating.

You can't afford to wait even a day in these situations - at any time the Feds can realize they don't need you - either because of newly discovered evidence in their investigation or because somebody else turned first. In either circumstance, you're then nott needed for anything anymore. So you strike before the Feds can know whether they need you or nott - that's when you have maximum value if you can roll over on other criminal activities by others.
