Read item #'s 40 and 41 of Complaint

Not saying that it will, but the door has been opened for damages which included the cost for expensive trials that Amarin incurred which should have been unnecessary according to the stance the FDA is now taking. No one can be certain in which direction the case will go as the Judge is the one who will, or will not access those damages.
