My understanding is that the judge does that as the evidence or exhibits are presented by counsel. Evidence can be backed up by briefs for/against, which the judge rules on.
But he does not send investigators out to do groundwork, and certainly not for issues outside the bounds of the case. Not sure where you are getting that idea.
