He will not rule on SPA. If he won't rule on SPA how it could influence his decision on NCE (since he do not know that FDA was right or wrong re the SPA).
I do not say that he and his staff could not be aware of other issues, however they will not conclude anything from these. They could not, w/o a judgement. Top of this: these are independent issues. (Maybe it's a part of a "big plan", but this is a theory only.)
You do not understand the basic fact that the judge cannot and will not consider anything related to SPA WITHOUT HEARING ABOUT IT FROM BOTH PARTIES!!! where is he receiving this "investigative information" from? Don't generalize, be specific. Whatever that source, do both sides get to explain themselves? According to you, it's a no, and you, sir, are very wrong
