Yes, it was specific. But no actual sanctions were applied. Had the judges wanted to go further, they could have fined them. Maybe held them in contempt.

Perhaps, or it may refer to the claim that at his allocution Foley did not admit to defrauding GVR. I think that is what the admonishment relates to, but you might be right. It's not exactly clear.

I don't think the attorney misrepresented that there was a no appeal of sentence clause in the plea agreement.

I do believe they misrepresented the allocution record when they claimed that Foley's admission of guilty was to a count that did NOT include GVR as the fraud victim.

It's also possible we're both wrong and the misrepresentation was regarding the nature of the crime of fraud (and the conspiracy to commit same) and that GVR could not conceivably be the victim of fraud since Foley made no representation to GVR.

Who knows. All I know is Foley is going in the can and I can't wait to write him as well as many of his new, large Hispanic colleagues in DaJoynt.
