When you compare the fighting words in FITX's March 12 Letter To Shareholders:

Due to CEN Biotech's never ending affinity for its loyal shareholders (Ha!), it will not sit idly by and allow mischaracterizations and the dissemination of falsities to destroy the Company, but will continue to fight and utilize all legal means to continue to fight for licensure.

Specifically, due to the factual misrepresentations and fraud disseminated by certain news agencies and unscrupulous bashers seeking to soil the Company's reputation in the court of public opinion for the purpose of monetary and political gain, the Company has turned to the federal court of Canada for determination of whether CEN has complied with all of the requirements for license issuance. The determination regarding licensure must be dependent on the true facts and evidence, which until now, have seemingly gone unnoticed.
CEN Biotech firmly believes that when the Court reviews the facts surrounding the application, and not fraudulent representations, unsupported statements and mischaracterizations, that it will quickly agree with our position. Facts cannot be ignored, and the facts surrounding the CEN Biotech application support issuance of a license.

The Company has the highest confidence in the federal court to finally have an unbiased and scrupulous review of the true facts involved with its application, which facts the Company believes will prove to the Court that CEN Biotech has in fact complied with all requirements under the MMPR for issuance of a license to grow.



To the lameness of their sudden discontinuance of their own lawsuit,
one wonders. And wonder, and wonder again.

We can expect an new Letter to Shareholders early next week. Maybe FITX will try to paint a brave face over the hopes they raised about 3 weeks ago, and that they have now dashed.

Of course, True Believers will keep on believing that FITX or CEN are just on the verge of becoming major pot growers, or that Energy Drink will somehow make up for the CEN Biotech losses.

“The judicial review application was withdrawn by CEN Biotech,” a Health Canada spokesperson said in an e-mailed statement to The Globe and Mail.

“There was no settlement. The decision not to grant a license to CEN Biotech was not a negotiation, it was made by Health Canada Officials.”

The move brings to a close CEN Biotech’s efforts to secure a licence in Canada’s recently privatized medical marijuana sector.
