But, it still doesn't have a water main. Nor, a substation. Nor does anyone there have any experience growing marijuana. That is great information. I am glad Bill C's new accommodations are completed.

You are correct it is a moot point. FITX is dead. 3 people can't fix that.

Indoor or outdoor makes no difference - there will not be any MMJ grown in the Rear Road facility.

FITX/CEN cannot even grow MMJ on the Rear Road parcel. There is no grandfathering.

Council decision on Medical Marihuana and Hemp production
Posted November 06, 2014

Council has passed an Official Plan Amendment and Zoning Bylaw Amendment to provide for the establishment of Health Canada licenced facilities, under the new Marihuana for Medical Purposes Regulation (MMPR) and Industrial hemp Regulations at its Special Meeting of November 4, 2014.

Council has provided for the establishment of licenced Hemp facilities in Agriculture designated / zoned lands only and, licensed Marihuana facilities in Employment designated/ zoned lands only. All proposals for these facilities will be considered on a site specific basis (a zoning by-law amendment is required to permit these facilities).

Council’s decision on the Official Plan Amendment (OPA No. 6) will be forwarded to the County of Essex, the Upper Tier Municipality, for consideration and approval. The County will publish a decision on OPA No. 6 in the near future, with a 20 day appeal period. The Zoning By-law does not come into effect until the Official Plan Amendment has been approved by the County and is in “full force and effect”.

The subject North Rear Road properties are zoned and designated Agricultural and the current structures are consistent with the designation and zone. However, the growing or processing of medical marihuana at these sites would not be permitted under their current zoning. An applicant would be required to apply for a Re-zoning of the site. They are not ‘grandfathered’ under the Council amendment.

For those of you who have not seen the pictures and have not gone onto google maps, The MMJ site is on agricultural land not residential land. Plants were there before and will be again. This time they will be indoors being grown by experts who control processes that ensure there is never a problem. For those of you that don't know, there was just recently a jail built where the citizens did not have a choice. Just like this one. Its a moot point and its been over communicated and the appeal period is gone. They know that 3 people won't overturn a decision.

The appeal period has just begun and it appears unlike the jail, (I believe it is actually a police station maybe with a few holding cells), the people did have a choice. Not sure they didn't have a choice with the Police Station but not important here. It will be interesting to see if Bill appeals. This is now real. Either Bill appeals or does some other alternative... sue the town, move operations, close up etc.

But this is the most real thing that has happened to FITX. The town government and people have spoken after many months and the Ball is in Bill's hands. Do nothing and FITX is over in Lakeshore. Appeal then all the past saying FITX grandfathered and no zoning issue from Bill are either not true or his council contrary to what he always claims is not the best and brightest.

So here FITX is Dec. 2014 and no license and 21 days to appeal the town gov. decision. As I said this is the most real thing that FITX has had to face. They literally have to make a decision to keep the amazing journey from coming to and end. We will really see what FITX is made of. No letter to shareholders or fluff PR or new LLC, "Bill said" or BOD appointment will suffice here. They actually have too, if they chose to continue, respond somehow. We now see FITX true colors.
