The request for en banc review will not be ruled upon the day it gets filed so October 15th is just another date. We don't know when the CAFC will decide upon the request. Don't set a deadline that doesn't exist, other than for a filing deadline for the request itself. The fat lady won't even chirp that day. Everyone knows it's coming as the company has already PR'd they will request en banc review.
