OD, Good point. Yes you are right on. I now remember from following other cases that the ITC partially became a more popular venue because of the ebay case decision. The hurdle is now higher in the Federal Courts to get injunctions issued than previous years. Let's hope the Federal Court can drive settlement without the threat of injunction in IDCC vs. Nokia.
