The other thing that comes to my mind is that having announced a 40:1 ratio, is the pps being artificially nailed down to ensure that the RS happens at this ratio.

Is the higher ratio only a ploy to substantially reduce the outstanding shares from 800 million to 20 million????

Shail, A few people are bailing before the Q report.

If the Q is not impressive then retail investors will vote 'no' to the RS for the exact reason you give ( if they are still around ).

If they hang around then an 'insider' majority could easily sway the vote and retail investors are along for the ride.

Worst case scenario is a bad Q and the RS still occurs - unless of course they have some blockbuster news to go along with the RS.

A decent Q report is enough to bring back some old and new investors which should boost the SP.

Quite a poker game indeed.

They cant uplist just because they want to uplist. As others have reported, to uplist you MUST meet certain levels of income. I really dont think that APDN would do this for 1 quarter and then let it all fall down. They would want to sustain the listing for as long as possible.
