OD, So why do you think the CAFC chose not to find infringement based on their remanded claim construction? It's not like they are overturning a jury finding. It seems to me that an appropriate decision from the CAFC would have been to either find infringement or not and allow the loser to appeal to the CAFC for an en banc hearing if desired. This current process stinks to high heaven and serves only the attorneys. Again, Sickening!
