Dave D: I believe the emphasis is on what NOKIA is not allowed to do; not on where it is allowed to be done. There is a difference - it inhibits the actions of the party, not where those actions are performed. Pretty clear to me that ONLY those stated in the PLA can see this document - and, I don't think that UK Judge is so mentioned therein. As stated in the papers though, if the UK Judge orders its delivery, Nokia can deliver.

Dave: As I noted before, the restraining order is only against Nokia. It does not prevent the UK Court from issuing an order requesting the documents. IAW the terms of the restraining order, Nokia can comply with such a court order.

From the FRCP

d) Form and Scope of Injunction or Restraining Order.

Every order granting an injunction and every restraining order shall set forth the reasons for its issuance; shall be specific in terms; shall describe in reasonable detail, and not by reference to the complaint or other document, the act or acts sought to be restrained; and is binding only upon the parties to the action, their officers, agents, servants, employees, and attorneys, and upon those persons in active concert or participation with them who receive actual notice of the order by personal service or otherwise.
