As a technical point, I don't think he can be considered a recidivist criminal until he's done his time for the first round of felonies.
As you know, he's managed to delay his incarceration now for over 2.5 years, longer than the term of the imprisonment itself, by playing legal tricks and going back on his obligations under the guilty plea arrangement.
If he'd actually done his time like a man for those crimes he committed, I'd be much more inclined to cut the man a break, especially for the sake of his family.
