The trademark application process is in session. The trademark is not fully registered until there is a product/service. It is considered a NOA with an intent of use. If they do not have an actual product/service in use within 3 years of the date the NOA was issued, the trademark is considered "abandoned" and the application process would start from the beginning.

The most legal trademark protection would be to have an actual/product service with a registered trademark. That's just a fact.

That doesn't mean it won't happen. Show me where you believe the trademark is registered. I see NOA- an opposition- an abandonment- an extension.
