I think ATVI is in excellent position and WDDD can refile all they want. WDDD's legal position might be one of the worst out of the 29 PIPCOs in the market. The new November 1996 priority date is going to cause problems with invalidity and the NCSoft settlement is going to cause problems with damage theories. WDDD is also almost out of money with only 22K reported as of 12/31/2013.
