Whether or not the hedge funds owned Fannie stock before the conservatorship is irrelevant because the stock is publicly traded. The government made a mistake by not placing Fannie and Freddie into Receivership and winding them down. The government allowed the stock to be traded and therefore allowed the Hedge Funds to buy the stocks and thus gave them the power to sue for their rights and ours.
True, Blue. Especially when it mainly becomes a matter of 'motivation' of the hedge funds. That is why it is an intriguing situation. How would the Judge approach this matter when the Gov. has shown inconsistency in their actions in trying to protect the taxpayer and the hedge funds are acting like 'piranhas' smelling blood. What appears here is a case of two 'contradictory' motivated parties and the interpretation of the law when it comes to legality and fairness.
