But since you're on that subject, yes the filings say Kreiger confirms there was a DFI/DFMI merger, no idea how you can read them any different Jay. There is TONS of documents from Simpson and Haskins confirming the codec license rights moved to DFMI and DFI President Simpson signed the Iterated license with Sloan that specifically says they merged and DFMI assumed the rights. All DFI shareholders turned in their DFI certs and got DFMI certs. Not sure how anyone could see it differently. Whine all you want that's how that will go down if it goes to trial.

But its unlikely to go to trial, unless the new judge decides she doesn't want to wade through that 10,000 pages before Tuesday. Most likely its a slam dunk win for the defendants and TMM faces a Billion dollar countersuit after Tuesday. Or the judge punts it to trial and the same result happens a year later, we'll see.
