IDCC & ITC

Im still hopeful we get infringement from the 868 case. If the ALJ totally disregards the 613 CAFC ruling(which we know he is bound by) then its pretty obvious IDCC is not going to get anything from the ITC. It appears the staff is hell bent on proving non infringement. The questions is what is IDCC's alternative if in fact the ITC rules against IDCC? Going to the CAFC won't do anything if the 868 case is ruled against IDCC.

I was very hopefuly the Huwaei arbitration would lead to others joining them and I still believe it might however if we stike out 3 times at the ITC what is next? Going to Deleware will take several years and with appeals and delays will be a joke. I sure hope IDCC has a plan they started the ITC action in 2007 and to date sill haven't gotten any resolution. I am still hopeful the ALJ in the 868 case will rule in favor of IDCC, I still don't know he rules against IDCC by following the 613 CAFC ruling. IF he does IDCC needs to readjust quickly and hopefully get everyone to arbitration under Huawei.
