It seems RIMM has used the delays in the legal system to develop their work around, which may now get implemented. My inference was that RIMM pulled out of that ~$450M licensing deal a while back, probably because RIMM was confident about their NTP patent workaround.

I have no sympathy for thieving infringing companies. But, it would not surprise me if the injunction is granted (excluding of course US government users, since the US has free use of all patents [as the patent grantor]), Rimm implements their workaround, NTP gets the adjudged royalty rate and interest for past infringement ~$250M or so already reserved by RIMM, and RIMM ends up paying less than the prior settlement amounts projected.
