Thanks GBR. I see your point about the invalid determination of '970. If the patent is invalid, then the infringement is moot whereas if the patent is valid there is an additional burden of proving the infringement. Anyway, olddog967 has provided some explanation on the summary determination that I referred to...I think the approval that Samsung got might be just to file for partial summary determination not necessarily a finding of summary determination in their favour.
I agree with you 100% that this is a big political game where IDCC got stuck and struck while the big players have their way. ITC doesn't have the muscle or intention to set it right.
Hoping for a brighter day for IDCC longterm holders.
